Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Nextwave Academy website and mobile application (the "Service") operated by Nextwave Academy ("we", "us"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility & accounts
You must be at least 13 years old to use the Service. You are responsible for the accuracy of the information you provide and for keeping your password secure. You agree not to share your account; we limit each non-admin account to 2 active devices and may revoke sessions to enforce this.
2. Course access & licence
When you enrol in a course (free or paid), we grant you a personal, non-transferable, revocable licence to access that course's lessons, quizzes, and materials for your own learning. You may not download, record, redistribute, resell, or publicly display the content. Downloading via screen recorders or third-party tools is a violation of these Terms and may result in account termination without refund.
3. Payments
Paid courses are processed by UddoktaPay. Prices are shown in BDT and include any applicable taxes. After successful payment, your enrollment is activated automatically. If your payment succeeds at the gateway but enrollment does not activate, contact us within 7 days and we will resolve it.
4. Refund policy
Because course content is delivered digitally and immediately, all sales are final. We may, at our discretion, issue a refund within 7 days of purchase if you have completed less than 20% of a course and have a documented technical issue we could not resolve. To request a refund, email info@nextwaveacademybd.com with your invoice id.
5. Acceptable use
- Do not attempt to bypass authentication, payment, or watermarking.
- Do not upload viruses, scrape the Service, or interfere with other users.
- Do not post content that is illegal, defamatory, hateful, or infringes others' rights.
- Do not impersonate any person or misrepresent your affiliation.
We may suspend or terminate accounts that violate these rules.
6. Intellectual property
All courses, videos, written material, branding, and software are owned by Nextwave Academy or our licensors and are protected by copyright and other laws. Submissions you upload (e.g. assignment files, suggestions) remain yours, but you grant us a non-exclusive licence to host and use them to operate the Service.
7. Third-party services
The Service integrates with Google (sign-in), UddoktaPay (payments), Supabase (hosting), Cloudflare (CDN), and Resend (email). Your use of those features is also subject to those providers' terms. We are not responsible for third-party services we do not control.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that course completion will result in any specific outcome (admission, grade, or job).
9. Limitation of liability
To the maximum extent permitted by law, Nextwave Academy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 6 months before the claim.
10. Termination
You may close your account at any time. We may suspend or terminate your access if you breach these Terms or if required by law. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability) will survive.
11. Governing law
These Terms are governed by the laws of the People's Republic of Bangladesh. Disputes will be resolved in the courts of Dhaka, Bangladesh, unless local mandatory law provides otherwise.
12. Changes
We may update these Terms from time to time. Material changes will be announced on this page; continued use after the change constitutes acceptance of the new Terms.
